Terms & Conditions
1. Parties to the Tourist Rental Agreement
Allagi Consulting, S.L., with tax identification number NIF B16395543, residing at Calle Antonio Jaramillo Bernaldez, 2, bloque 3 BJ C, Gelves, Sevilla (hereinafter the OWNER), acts as the lessor of the properties offered on this website (hereinafter the ACCOMMODATION) to tenants (hereinafter the GUEST).
2. Purpose
Allagi Consulting, S.L. leases the requested ACCOMMODATION for the sole and exclusive purpose of tourist use, different from the GUEST's usual place of residence, during the agreed lease period. The property is in perfect condition, clean, and equipped with the appliances, household items, facilities, furniture and supplies necessary for immediate habitation. The ACCOMMODATION shall not, under any circumstances, serve as the permanent residence of the GUEST, and the GUEST may not alter this purpose. Failure to comply will result in termination of the contract.
3. How to make a reservation
Before making a reservation, the group's representative must carefully read these conditions. The person who signs or requests the reservation does so on behalf of all group members, binding them collectively to these terms and conditions. Once your reservation is confirmed, we will assign the chosen property and confirm your reservation on our calendar.
4. Payment and cancellation policy
The GUEST will pay the OWNER the price set for the requested ACCOMMODATION, according to one of the following reservation policies:
- Flexi: the full reservation price is paid, and is refunded to the GUEST in case of cancellation up to 30 days before arrival.
- Medium: a non-refundable 50% reservation fee is paid; the remaining amount is paid 30 days before arrival. Once the total is paid, no refund is possible.
- Strict: 100% is paid in advance, with no possibility of refund in case of cancellation.
Where charges such as cleaning fees are associated with the reservation, these will be refunded if the reservation policy allows it. In the case of a no-show, these will be refunded at 50%. A reservation is considered cancelled on the day the OWNER positively responds to a cancellation request made in writing by the GUEST to info@alandalux.com.
If, for reasons beyond the OWNER's control, it is not possible to lease the requested property, the OWNER will resolve it by: providing another property of equal rental value; providing another of lower value, refunding the difference; providing another of higher value, assuming the difference; or, if no alternative is possible, proportionally compensating the GUEST for the time that could not be accommodated. These penalties will not apply when cancellation occurs due to duly proven force majeure (an unforeseeable and/or inevitable event preventing fulfilment of the agreement). The OWNER may cancel the GUEST's reservation if any property rules are not respected during the stay.
Accepted payment methods: Stripe and bank transfer (the latter by prior agreement). All card transactions are invoiced in Euros, as the transaction takes place in Spain. Where a reservation is made by a company to accommodate its employees, current tax regulations apply (VAT and IRPF treatment as set out in Article 75.3.g of the Income Tax Regulation approved by RD 439/07 and TEAC Resolutions 3856/2013 and 3857/2013 of 15 December 2016); company rentals must be indicated at the time of booking, otherwise the OWNER reserves the right to reject them. Our prices are published with VAT.
5. Property rules
The GUEST agrees to abide by the property rules below at all times during the stay, and must inform any other beneficiaries of the rental, who must also abide by them:
- Do not exceed the maximum number of occupants.
- Adhere to check-in and check-out times.
- Smoking is not allowed in any of the properties.
- Parties or events are not allowed.
- Silence must be observed from 10 pm to avoid disturbing neighbours.
- Only guests listed in the original reservation are allowed to stay overnight.
- Taking any items from the property is not allowed.
6. Air conditioning and heating
All properties have air conditioning and heating, at no additional cost, except for stays exceeding 28 days (4 weeks), where a maximum electricity expense will be established to prevent abusive consumption. We do not accept responsibility for the failure of these facilities, although we will always strive to resolve issues as soon as possible. We do not accept responsibility for the malfunction, breakdown or non-use of any items where a specialist engineer/electrician is required, which may take up to five business days due to the terms of professional technical assistance.
7. Internet / Wi-Fi
All properties have a high-speed internet connection and Wi-Fi. We do not accept responsibility for technical failures in the line and will not pay compensation due to line failure, but will of course assist as best as possible.
8. Cleaning
Cleaning service is provided on the day of arrival and departure only. Upon request, it is possible to include laundry services, change of bed linen and cleaning during your stay.
9. Additional services
In addition to extra cleaning, other services are offered on demand and vary by property. Complimentary services such as luggage storage and early or late check-in are offered subject to availability and must be requested 48 hours prior to arrival.
10. Pets
Companion pets are welcome in our properties at no additional cost.
11. Penalty clause
The GUEST will return the property keys on the contract end date. In case of loss of access keys to a property or garage remotes, the GUEST may incur a penalty and must pay the OWNER €80 as a penalty clause.
12. Competent court and applicable law
For any issues or disputes arising from this contract, both parties agree to submit to the Courts and Tribunals of Seville, expressly waiving their own jurisdiction. This contract is of a civil nature and will be governed by its own clauses and, where not provided, by Decree 28/2016 of 2 February on Tourist Apartment Establishments of the Andalusian Government.
13. Acceptance of the contract
By making a reservation, the GUEST acknowledges having read and accepted these terms.
